IN THE PARLIAMENT OF THE UNITED STATES

JUNE 05, 2005

MR. JOHN SMITH(FOR HIMSELF) INTRODUCED THE FOLLOWING BILL.

SECTION 1. SHORT TITLE.

This act may be cited as the "Import-Export Control Board Establishment Act".

SECTION 2. CREATION OF BOARD.

There is hereby created a governmental entity referred to as the "Import-Export Control Board", whose duties are outlined below.

The board shall consist of thirteen members to be nominated by the President and approved by the parliament, to serve staggered terms of six years; for the first round of nominations, one third shall serve an initial term of two years, one third to serve an initial term of four years and the last third to serve a full term of six years.

SECTION 3. DUTIES.

The Import-Export Control Board shall issue annual import and export licenses which shall outline the products that may be exported or imported under the license and the total value of such products.

SECTION 4. STANDARDS FOR ISSUANCE.

The Import-Export Control Board shall review applications for annual licenses on the following basis--

(i) Whether or not the proposed products and values are in line with the social values of the government and parliament;and

(ii) Whether or not the proposed products may, if exported or imported, cause harm to the peoples of these United States;

SECTION 5. COURT REVIEW OF DENIALS.

The courts of these United States may review any decision to deny an application upon petition from the agrieved party. The following shall be the basis of the review--

(i) Whether undue or corrupt bias was shown as evidenced by approval of similar licenses in the same year;and

(ii) Whether any legal error was made in the interpretation of the standards.

SECTION 6. CRIMINAL AND CIVIL PENALTIES.

(1) Whoever knowingly exports or imports without a license shall be subject to a term of imprisonment not to exceed five years and a fine not to exceed $1,000,000.00.

(2) Whoever knowingly exports or imports without a license shall be subject to a civil penalty assessed by the control board, not to exceed $50,000.00 per instance of violation and not to exceed a total aggrate value of $1 million.
