Where is the line between a woman's right to choose and a child's right to life? I have drawn up some guidelines in my bill. It will try to deal with issue, and accordingly to wills expressed and veiws that have been made known. Provisions: TIME OF ABORTION: P.1) In the First Trimester: All women have the right of Abortion. All Abortions of a Fetus shall be made known on the woman's official health record. P.2) In the Second Trimester: A women's right to abortion is restricted to only when one of the following cases are at hand: a) Rape b ) Incest c)Child is Developing Severe Birth Defects d) Mother's Life and/or Health is at Risk P.2.2) By Law, the Abortionist or whoever will be performing the Aborting Procedures must explain to the woman all possible effects from having the pregnancy aborted. P.3) P.3) In the Third Trimester: Abortion of Pregnancy is Illegal. AFTER PASSAGE OF BILL: P.4) Any Doctor who performs a 'Partial Birth' abortion will have his/her practicing license removed, and can only apply for reinstatment after 1 year. REGARDING MINORS: P.5) All Females Under 18 Must have Parental Consent before having an Abortion. Final Statements: Whether being Pro-Choice or Pro-Life, this Bill will garuntee something for your cause, take that into consideration, whereas needed pieces is better than no action. And in regards to abortion in the very late stages, the Surgeon General has said that, with Modern Medicine, such an operation is never needed to save or help a mother's health. Amended Bill. There shall be a private cause of action in negligence for violation of this subsection (d) By Law, the physician or othe care provider must obtain consent if the woman is an unemancipated minor, from one of the following: (1) A parent (2) A legal guardian (3) A federal or state judge or magistrate judge of competent jurisdiction. (e) A knowing, willful, or reckless violation of this section by a physician or care provider shall constitute a high misdemeanor and result in one or more of the following penalties: (1) loss of license for a period not to exceed one year. (2) a fine of at least $5,000 and not exceeding $100,000. (f) This section pre-empts all federal statutes and  the statutes of the several states.
