A BILL To permanently repeal the Taiwan Relations Act. Text of TRA: http://www.ait.org.tw/en/about_ait/tra/ Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled. SECTION 1. SHORT TITLE. This Act may be cited as the `Taiwan Relations Act Repeal.' SECTION 2. FINDINGS. 1) The Taiwan Relations Act was signed into law on April 10, 1979 by President James Earl Carter. 2) The Taiwan Relations Act violates the terms and conditions of permenant normal diplomatic relations between the People's Republic of China and the United States of America, which included the termination of the Mutual Defense Treaty in 1979. 3) The Taiwan Relations Act provides advanced arms sales to Taiwan, re-establishing a defense treaty with the Taiwan government. 4) The Taiwan Relations Act allows the US government to have government-to-government contact 'unofficially' in name only, with the government of Taiwan, through the American Institute in Taiwan. 5) In April 2001, the United States government sold advanced arms in excess of the terms and agreements of the 1982 Shanghai Commnique. 6) The Taiwan Relations Act, and continued arms sales, constitute bad faith negotiating on the part of the United States, and are egregious violations of the sovereignty of the People's Republic of China. 7) The Cairo Declaration in 1943, the Potsdam Proclamation in 1945, Resolution 2758 of the UN General Assembly in 1971 all proclaim Chinese sovereignty over the territory of Taiwan, and that the territory of Taiwan should have been returned to China after the defeat of the Japanese imperialists in the Second World War. 8) There is but One China and Taiwan is part of China. SECTION 3. Taiwan Relations Act Repeal 1) TAIWAN RELATIONS ACT Public Law 96-8 is hereby repealed. SECTION 4. ENACTMENT CLAUSE. This bill shall take effect immediately upon passage. |
